Two Independent MLCs Join BJP in Bihar, RJD Demands Action Under Anti-Defection Law

Bihar politics has seen a fresh political dispute after two newly elected Independent members of the Legislative Council announced that they had joined the Bharatiya Janata Party (BJP). The development has led to objections from the Rashtriya Janata Dal (RJD), which has questioned whether the move is allowed under the Constitution.
The two MLCs are Banshidhar Brajwasi and Rahul Raj. They announced their association with the BJP on October 31 in Patna in the presence of senior party leaders, including Chief Minister Samrat Choudhary and BJP state president Sanjay Saraogi.
Why Did the Two MLCs Join the BJP?
Banshidhar Brajwasi won the Tirhut Graduates' constituency as an Independent candidate. He defeated JD(U) candidate Abhishek Jha.
Rahul Raj won the Saran Teachers' constituency. He had earlier been associated with the BJP but contested as an Independent after the seat was allotted to its alliance partner, the JD(U).
Both candidates defeated JD(U) nominees in their respective constituencies. Their decision to join the BJP after the election has therefore raised questions about political coordination within the ruling NDA alliance.
The BJP welcomed the two leaders and described their support as an addition to its strength in the Legislative Council.
Why Is the RJD Objecting?
The RJD has questioned the decision because both leaders were elected as Independent candidates.
RJD leader Tejashwi Yadav has demanded their disqualification, arguing that joining a political party after winning as Independents attracts the anti-defection provisions of the Constitution.
RJD leaders have also indicated that they may approach the appropriate authority and seek legal action.
However, a political demand for disqualification does not mean that the MLCs have automatically lost their seats. The legal position will depend on the applicable constitutional provisions and the decision of the competent authority.
The BJP's Position
The BJP has welcomed the support of both MLCs. However, the party's public position and the legal question about their membership are separate matters.
Banshidhar Brajwasi has also clarified that he extended support to the BJP rather than formally joining it. This makes it important to examine the exact nature of the announcement and any formal membership documents.
The issue may therefore involve questions about the difference between supporting a political party and formally becoming its member.
Questions Within the NDA
The development has also created questions about relations between the BJP and JD(U).
Both parties are part of the ruling NDA alliance in Bihar. However, the two Independent candidates defeated JD(U) nominees in the recent Legislative Council elections.
Some JD(U) leaders have questioned whether alliance partners supported their official candidates during the election campaign.
What Happens Next?
The next important development will be the response from the Bihar Legislative Council authorities and any formal legal application submitted by the opposition.
The case could raise an important question about the position of Independent legislators who decide to support or join a political party after being elected.
For now, the two MLCs have announced their support for the BJP, while the RJD is seeking action against them. The final decision will depend on the relevant constitutional process.
