Bihar Politics Explodes! Two Independent MLCs Join BJP, Opposition Threatens Legal Battle

Bihar politics has entered a fresh phase of confrontation following a controversial political development involving two newly elected Independent Members of the Legislative Council (MLCs).
Banshidhar Brajwasi and Rahul Raj, who secured victories as Independent candidates in the recent Bihar Legislative Council elections, announced their support for the Bharatiya Janata Party (BJP) on October 31, 2026.
Their appearance at the BJP's state headquarters in Patna, alongside senior party leaders and Chief Minister Samrat Choudhary, quickly became a major political talking point.
Initially, reports and statements indicated that the two legislators had joined the BJP. However, after questions were raised over the anti-defection laws of the Constitution, both leaders clarified that they had only extended support to the ruling party.
Who are the two Independent MLCs?
The controversy revolves around two legislators who won their respective constituencies as Independent candidates.
Banshidhar Brajwasi: Elected from the Tirhut Graduates' constituency. He secured re-election for a second consecutive term.
Rahul Raj: Elected from the Saran Teachers' constituency. He defeated JD(U) candidate Anand Pushkar.
Both victories were politically significant because the candidates defeated nominees of the BJP's NDA ally, Janata Dal (United).
RJD launches a strong political challenge
The Rashtriya Janata Dal (RJD) strongly criticised the development, arguing that candidates elected as Independents cannot subsequently join a political party without attracting the provisions of the anti-defection law.
RJD leader and Leader of Opposition Tejashwi Yadav demanded disqualification of the two MLCs.
He accused the BJP of undermining constitutional principles and argued that the Tenth Schedule of the Constitution applies to legislators elected as Independents who subsequently join a political party.
RJD leader Manoj Kumar Jha also indicated that the party would approach the Chairman of the Bihar Legislative Council and pursue legal remedies.
BJP's clarification adds another twist
The BJP's position became particularly important after the controversy intensified.
Bihar BJP president Sanjay Saraogi initially shared a message suggesting that the two MLCs had joined the party.
However, following objections, the earlier social media post was deleted and replaced with a clarification that the legislators had extended their support to the BJP.
Why this controversy matters for Bihar politics
The controversy is significant because it involves more than two legislators changing their political alignment.
It raises questions about the constitutional position of Independent representatives, the interpretation of anti-defection provisions and the political relationship between NDA partners.
Conclusion
Bihar politics is once again witnessing a battle where political strategy, alliance equations and constitutional rules are all under the spotlight.
