Chirag Paswan Questions BJP’s Move to Bring Independent MLCs Into the Party

Union Minister and Lok Janshakti Party (Ram Vilas) president Chirag Paswan has questioned the reported move by two newly elected Independent Members of the Legislative Council (MLCs), Bansidhar Brajwasi and Rahul Raj, to join the Bharatiya Janata Party (BJP). His remarks have added another political dimension to the controversy surrounding the legislators' post-election association with the ruling party in Bihar.
Speaking to reporters in Patna on November 3, Paswan raised concerns about the legal and moral implications of the development. He indicated that if legislators elected as Independents formally join a political party after winning their elections, the decision could face constitutional hurdles.
The comments are significant because Paswan's party is an ally of the BJP in the National Democratic Alliance (NDA). His intervention has brought attention to the need for coordination among alliance partners at a time when the relationship between the BJP and JD(U) is also under discussion.
Chirag Paswan Raises Constitutional Questions
The controversy concerns two MLCs who contested the recent Bihar Legislative Council elections as Independent candidates. Bansidhar Brajwasi won from the Tirhut Graduates' constituency, while Rahul Raj secured victory from the Saran Teachers' constituency.
Following their victories, both legislators were seen at a BJP programme and initially announced that they had joined the party. Their public association with the BJP subsequently triggered questions about the constitutional provisions governing Independently elected legislators.
Paswan said that if the two MLCs had formally joined the BJP, the decision could involve legal hurdles and questions of political morality.
The BJP, however, has maintained that the legislators had extended support to the party rather than formally becoming members. This distinction has become central to the political and constitutional debate.
JD(U) Concerns Add to NDA Discussion
The development has also attracted attention within the JD(U), another major constituent of Bihar's ruling NDA. Both Independent MLCs had defeated candidates supported by the JD(U) in the recent elections.
The issue has therefore raised questions about political coordination between the BJP and JD(U), particularly when candidates from the same alliance were competing in the council elections.
JD(U) leaders have expressed concerns about the manner in which the two legislators were welcomed by the BJP. The party's position reflects the political sensitivity surrounding electoral contests between alliance partners.
Paswan's remarks have further highlighted the importance of maintaining mutual understanding among NDA constituents.
Opposition Parties Demand Action
Opposition parties have also questioned the legislators' decision. RJD leader and Leader of Opposition Tejashwi Yadav has sought action against the two MLCs, arguing that joining a political party after winning an election as an Independent could attract disqualification provisions under the Tenth Schedule of the Constitution.
The matter has also reached the office of the Bihar Legislative Council Chairman, with Jan Suraaj raising objections and seeking action.
The legal question will depend on the legislators' actual membership status and the applicable constitutional provisions. Political statements alone do not determine whether disqualification is warranted.
A Test of Alliance Coordination
The controversy has created a difficult political situation for the BJP, which must address questions from opposition parties as well as concerns raised by its allies.
For Chirag Paswan, the issue also places constitutional principles and political morality at the centre of the discussion. His comments demonstrate that alliance partners may maintain independent positions even when they share power at the state and national levels.
The next developments will depend on the clarification provided by the two MLCs, the BJP's position on their association and any decision taken by the Legislative Council Chairman.
For Bihar's NDA, the episode is another reminder that electoral competition between alliance partners can create political disagreements even after the elections are over.
Editorial verification note: The BJP's position that the MLCs extended support rather than formally joined the party must be retained in any updated version. Do not describe their disqualification as confirmed.
