Bihar NDA Faces Political Tension After Two Independent MLCs Announce Support for BJP; Opposition Seeks Disqualification

Two Independent MLCs Announce Support for BJP
Bihar's ruling BJP-led National Democratic Alliance (NDA) has faced a fresh political controversy after two newly elected Independent Members of the Legislative Council (MLCs), Bansidhar Brajwasi and Rahul Raj, announced their support for the Bharatiya Janata Party.
The development took place on October 31, when the two legislators attended a BJP legislative party meeting at the party's state headquarters in Patna. The meeting was chaired by Chief Minister Samrat Choudhary and attended by senior BJP leaders, including state president Sanjay Saraogi.
Initially, both MLCs publicly stated that they had joined the BJP. Photographs showing them with BJP membership slips and party scarves also circulated widely. However, after questions were raised about the constitutional implications of their move, the BJP and the two legislators clarified that they had only extended support to the party rather than formally joining it.
RJD and Jan Suraaj Demand Disqualification
The development triggered strong reactions from opposition parties, particularly the Rashtriya Janata Dal (RJD) and the Jan Suraaj Party.
RJD leader and Leader of the Opposition Tejashwi Yadav demanded action against the two MLCs, arguing that elected Independent legislators cannot join a political party after winning their seats.
RJD MP Manoj Kumar Jha also indicated that the party would approach the Chairman of the Bihar Legislative Council seeking their disqualification. The opposition has argued that the legislators' initial public statements and the membership-related photographs could be relevant evidence.
The Jan Suraaj Party has also challenged the move and sought action from the Council Chairman. Its leaders have argued that the legislators' initial claims of joining the BJP should be examined under the constitutional provisions governing defections.
What Does the Anti-Defection Law Say?
The controversy centres on the Tenth Schedule of the Indian Constitution, which contains provisions dealing with disqualification on grounds of defection.
Under Paragraph 2(2) of the Tenth Schedule, an elected Independent member becomes liable for disqualification if they join a political party after being elected.
However, the key question in this case is whether Brajwasi and Rahul Raj formally joined the BJP or merely extended political support to the ruling party.
The BJP has maintained that the two legislators have only offered support. The final decision on any disqualification petition rests with the Chairman of the Bihar Legislative Council, subject to judicial review.
Both MLCs Had Defeated JD(U) Candidates
The controversy has an additional political dimension because both Independent candidates defeated nominees of the BJP's NDA ally, Janata Dal (United), in the recent Bihar Legislative Council elections.
Bansidhar Brajwasi retained the Tirhut Graduates' constituency, defeating JD(U) candidate Abhishek Jha by 9,147 votes.
Rahul Raj won the Saran Teachers' constituency, defeating JD(U) candidate Anand Pushkar by 1,815 votes. Rahul had earlier been associated with the BJP but contested the election as an Independent after the NDA nominated a JD(U) candidate for the seat.
Their subsequent support for the BJP has raised questions about the relationship between the two major NDA partners and the treatment of alliance candidates.
Discontent Emerges Within the NDA
The election results and the subsequent political developments have also exposed dissatisfaction within the NDA.
JD(U) leaders expressed concerns over the defeat of their candidates, particularly in the Tirhut Graduates' constituency. JD(U) MP Devesh Chandra Thakur questioned whether NDA leaders had sincerely supported the party's candidate Abhishek Jha during the election campaign.
The allegations have added to concerns about coordination between the BJP and JD(U), even as both parties remain partners in the Bihar government.
BJP's Position and Political Implications
The BJP has defended the two legislators' decision to support the ruling alliance, arguing that their backing reflects confidence in the government's leadership and development agenda.
For the BJP, the support of the two MLCs could strengthen its position in the Bihar Legislative Council. For the JD(U), however, the development carries political significance because both legislators defeated its candidates before aligning themselves with the BJP.
The controversy is now likely to move into a constitutional and political debate over the distinction between joining a political party and extending support to a government.
What Happens Next?
The next important development will be the response of the Bihar Legislative Council Chairman to any formal disqualification petition. The opposition may also pursue legal remedies if it believes the legislators violated the Tenth Schedule.
The episode has become an important test for the NDA's internal coordination and the interpretation of anti-defection provisions in Bihar. Its outcome could have implications for the political balance within the Legislative Council.
